1. Acceptance of the Terms
By accessing or using the Dialoga AI platform, you fully agree to these Terms of Use and to our Privacy Policy. If you do not agree with any provision, we recommend that you do not use the platform.
Continued use after updates to these Terms means acceptance of the new conditions. We will always publish the date of the last update at the top of this page.
2. Description of the Service
Dialoga AI offers a continuous listening platform based on artificial intelligence, through which employees of contracting companies take part in one-on-one interviews conducted by our AI, Laura. The results are anonymized, analyzed and consolidated into aggregated reports made available to leadership and HR.
The service includes:
• One-on-one conversations with Laura through a web interface.
• An employee dashboard with access to their own history ("My Results").
• A management dashboard with metrics, trends and alerts for managers.
• Automatic generation of action plans based on the data collected.
3. Access and Account
Access to the platform is provided exclusively by the contracting company, which is responsible for registering and managing users. There is no public signup or self-registration.
You are responsible for:
• Keeping your login credentials confidential.
• Not sharing your login or password with third parties.
• Immediately notifying your manager or Dialoga AI support in case of unauthorized access.
Dialoga AI is not responsible for improper access resulting from failure to meet these obligations.
4. Acceptable Use
By using the platform, you agree to:
• Provide truthful, accurate information in good faith during interviews.
• Not attempt to access data belonging to other employees, managers or restricted areas.
• Not reverse engineer, decompile, extract or reproduce the platform's source code.
• Not use the platform for illegal, defamatory, discriminatory or harmful purposes.
• Not submit malicious content, spam or false information intended to manipulate reports.
• Respect the intellectual property rights of Dialoga AI and third parties.
Failure to comply with these conditions may result in immediate suspension of access.
5. Responsibilities of the Contracting Company
The contracting company assumes the following responsibilities toward its employees and Dialoga AI:
• Informing employees and, when necessary, obtaining their consent to use the platform, as required by the LGPD.
• Complying with the legal obligations applicable to data processing within its organization.
• Appointing a person responsible for managing access and for the ethical interpretation of reports.
• Not using the data or reports generated by the platform for discriminatory or punitive purposes, or in breach of labor law.
• Not sharing employees' individual access with other people.
6. Intellectual Property
All content, technology and branding of Dialoga AI, including the AI Laura, algorithms, language models, interfaces, design and documentation, are the exclusive property of Dialoga AI and protected by intellectual property laws in force in Brazil and internationally.
The reports and data generated from the answers of the contracting company's employees belong to the contracting company, within the limits established by the LGPD and the service contract.
Reproducing, adapting or commercially exploiting any element of the platform without the express written permission of Dialoga AI is prohibited.
7. Artificial Intelligence and Limitations
Laura is a generative AI trained to hold empathetic conversations and analyze patterns in workplace feedback. Like any AI system, it may occasionally produce inaccurate responses or miss nuances specific to each context.
The insights and reports generated by the platform should be interpreted as decision support, not as a definitive diagnosis or a substitute for human judgment. Dialoga AI recommends analyzing the results together with other sources of information and by listening directly to people.
8. Limitation of Liability
Dialoga AI is not responsible for:
• Strategic, operational or employment decisions made by the company based on the reports generated.
• Temporary service interruptions due to scheduled maintenance or force majeure.
• Indirect, incidental or consequential damages arising from the use of, or inability to use, the platform.
• Content submitted by users that violates these Terms or the rights of third parties.
Our total liability under any circumstances is limited to the amount paid for the service in the 12 months preceding the event that gave rise to the claim.
9. Service Availability
Our goal is to keep the platform available 99.5% of the time each month. Availability is measured by an external monitor that checks the platform every few minutes, and the history is published in the Trust Center. Scheduled maintenance will be announced at least 48 hours in advance by email or by a notice on the platform.
We do not guarantee uninterrupted availability in cases of force majeure, third-party infrastructure failures or cyberattacks. In the event of an incident, we notify the managers of affected companies by email, with an estimate for recovery, and record what happened in the public incident history.
10. Termination and Suspension
We may suspend or terminate the access of a user or a contracting company in case of:
• Violation of these Terms of Use.
• Contractual default after formal notice.
• Use of the platform for fraudulent or illegal purposes.
In these cases, we will notify the contracting company with reasonable advance notice, except when the urgency of the situation justifies immediate action.
The contracting company may terminate the contract at any time under the conditions set out in the commercial agreement signed with Dialoga AI.
11. Changes to the Terms
These Terms may be updated from time to time to reflect changes in the service, in applicable law or in our practices. We will give at least 30 days' notice of material changes by email or by a notice on the platform.
The current version will always be available on this page with the date of the last update. Continued use after the new conditions take effect means you accept them.
12. Governing Law and Jurisdiction
These Terms are governed exclusively by Brazilian law, in particular Law No. 13,709/2018 (LGPD), the Civil Code and the intellectual property legislation in force.
The courts of the Judicial District of São Paulo, State of São Paulo, Brazil, are chosen to resolve any disputes arising from these Terms, except where consumer protection law determines a different venue.
